THE PROBLEM

After an automobile importer had terminated a concession agreement with one of the most important recognised distributors within the network, the distributor filed a complaint against the importer. Even though the importer had observed a notice period, the distributor felt that the termination was unlawful and therefore claimed compensation.

THE SOLUTION

All elements inherent to the automobile sector came up for discussion during these proceedings. Both our national distribution law and European competition law (Block Exemption Regulation) were cited in this legal dispute.
