THE PROBLEM

A Swedish distributor distributed its equipment in Belgium via a Belgian distributor. This distributor suddenly refused to continue paying invoices issued by the Swedish manufacturer, hiding behind the allegation that the products delivered were defective. A negative expert report reversed the roles, so that the Swedish manufacturer suddenly found itself having to pay a multiple of its own claims against the Belgian distributor.

 

THE SOLUTION

Astrea successfully challenged the negative expert report before the court and obtained an order appointing a new expert. Once the new expert report was issued, Astrea suggested a pragmatic approach, and the parties reached an amicable settlement.
