Grondwettelijk Hof stelt schending vast van het gelijkheidsbeginsel in de toepassing van een verlaagd heffingstarief op een nieuw productieprocédé

Naar aanleiding van een prejudiciële vraag gesteld door de rechter in eerste aanleg werd nagegaan of de verschillende behandeling van heffingsplichtigen naargelang zij calciumchloride afvalstoffen storten die afkomstig zijn van een calciumchlorideproces dan wel van de productie van fosforzuur of van metallurgische processen een schending inhield van het gelijkheidsbeginsel.

Hoewel de productieprocessen gelijkaardig waren en storten in al deze gevallen als best beschikbare techniek werd aanzien, werd het verlaagd heffingstarief enkel toegepast bij de productie van fosforzuur en bij metallurgische processen.

Het Grondwettelijk Hof is haar arrest van 27 mei 2021 van oordeel dat er wel degelijk een schending is van artikel 10 en 11 van de Grondwet daar waar het verlaagde tarief niet werd toegepast op het productieproces voor calciumchloride doch wel voor de andere processen.

In die zin is volgens het Hof een verschillende behandeling voor wat betreft de toepassing van de heffingen niet redelijk verantwoord.

Constitutional Court finds violation of the principle of equality in the application of a reduced rate of levy to a new production process

Following a preliminary question asked by the court of first instance, it was examined whether the different treatment of taxpayers depending on whether they dump calcium chloride waste that originates from a calcium chloride process or from the production of phosphoric acid or from metallurgical processes constitutes a violation of the principle of equality.

Although the production processes were similar and landfilling was considered the best available technique in all these cases, the reduced tax rate was only applied to phosphoric acid production and metallurgical processes.

The Constitutional Court considered in its judgment of May 27, 2021, that there is indeed a violation of Articles 10 and 11 of the Constitution where the reduced rate was not applied to the production process for calcium chloride but to the other processes.

In this sense, according to the Court, different treatment as regards the application of the duties is not reasonably justified.
